1. Acceptance of Terms

By contacting LANDSCAPE LOGIC LLC ("we," "us," or "our"), requesting a quote, or engaging our landscaping services, you agree to be bound by these Terms of Service. These terms apply to all clients, prospective clients, and website visitors. The business is owned and operated by Donnie P Smith and governed by the laws of the State of Florida.

2. Description of Services

We provide professional landscaping services in Jacksonville, Florida, including landscape design, lawn care/maintenance, and irrigation installation/repair. All services are performed using industry-standard equipment and eco-conscious practices. We reserve the right to modify service offerings based on seasonal demand, weather, and scheduling.

3. Quotation & Ordering Process

  • Free Consultation: Initial assessments and quotes are provided at no cost. Quotes are valid for 30 days.
  • Service Agreement: Work begins only after written approval via email or signed contract.
  • Scope Changes: Modifications require a documented change order and may affect timeline/pricing.
  • Permits & HOA: Clients are responsible for municipal permits or HOA approvals. We assist with documentation.

4. Pricing & Payment

All pricing is in USD, custom-tailored to property size, complexity, materials, and labor. We operate on a transparent, no-hidden-fees model.

  • Deposit: May be required for large installations to secure materials/scheduling.
  • Payment Methods: Checks, bank transfers, major credit/debit cards.
  • Final Payment: Due upon completion/sign-off or within 7 days of service delivery.
  • Late Payments: Overdue invoices (15+ days) may incur a 1.5% monthly late fee.

5. Client Responsibilities

Clients agree to provide clear access to work areas, secure pets, notify us of underground utilities/sensitive areas, and maintain a safe working environment.

6. Cancellation Policy

  • Cancellation: Clients must provide 48 hours' notice to cancel or reschedule appointments. Late cancellations or no-shows may incur a service fee to cover scheduled crew time and materials.
  • Project Termination: Either party may terminate an ongoing project with written notice. Clients will be billed for work completed and materials purchased up to the termination date.
  • Refunds: Issued within 14 business days for unperformed services. Custom material deposits are non-refundable once procured.

7. Plant Warranties & Limitation of Liability

We guarantee our workmanship for 12 months from the date of completion. This warranty covers installation defects under normal use.

Plant Survival Warranties: Plant survival depends on environmental factors (weather, soil conditions, irrigation) and post-installation care. Specific plant guarantees will be outlined in your project proposal based on species and maintenance requirements. We do not guarantee long-term plant health due to factors beyond our control.

Limitation of Liability: To the fullest extent permitted by Florida law, LANDSCAPE LOGIC LLC shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total amount paid by the client for the specific service in question.

8. Intellectual Property

Design concepts, blueprints, and visualizations remain our intellectual property until full payment is received. Upon completion, clients receive a non-exclusive license to use the final design for their property only. Commercial reproduction is prohibited without consent.

9. Dispute Resolution & Jurisdiction

Disputes will first be addressed through good-faith negotiation. If unresolved, they will be subject to binding arbitration in Duval County, Florida. You agree to the exclusive jurisdiction of state/federal courts in Duval County, Florida.

10. Force Majeure

We are not liable for delays caused by circumstances beyond reasonable control (hurricanes, supply chain disruptions, labor strikes, government restrictions, etc.). Timelines will be adjusted accordingly with prompt communication.
